Medimee establishes this privacy statement to provide insight into the use of personal data on www.medimee.nl (hereinafter“the Web site“), and all domains related to the Web site.

Personal data means any information that identifies an individual, such as name, customer number and personal contact information. Data that are not personal, but in combination with personal data lead to identification of the user, also count as personal data.

  1. WHAT DATA ARE PROCESSED

When using Medimee’s website or services, the following personal data may be collected and processed:

Name information, email, phone number.

  1. PURPOSE OF PROCESSING THE DATA

In compliance with privacy laws, users’ personal data are used exclusively for the following purposes:

Delivery of products ordered in the web shop (www.medimee.nl).

Following Article 6 General Data Protection Regulation, the processing of personal data for the above purposes has the following basis:

  • The processing is necessary for the performance of a contract with the user. (paragraph 1(b))
  • The processing is necessary because of a legal obligation of the controller. (paragraph 1(c))
  1. RECIPIENTS OF PERSONAL DATA

Personal data may be provided by Medimee to third parties if it is compatible with the purpose stated in this privacy statement for which the data was collected. Data may be transferred to the following recipients on behalf of Medimee:

Logistics service providers
Transporters.

Personal data will be provided only for the period and extent necessary to carry out the order given by Medimee to the recipients.

In all cases of disclosure of personal data to third parties, Medimee shall ensure that the data are used only for the intended purposes and are kept in accordance with the legally assured level of protection.

Medimee never sells user data for commercial purposes.

  1. DATA RETENTION PERIOD

Personal data will not be used or stored by Medimee for longer than necessary to achieve the purposes for which the data are collected in accordance with this Agreement.

  1. RIGHTS OF USERS

The user of the website can exercise his rights at any time with respect to Medimee.

Users may make their request for the exercise of one or more of their rights known to Medimee using any of Medimee’s contact information listed in this privacy statement.

Medimee will comply with the user’s request, unless the request is unfounded or excessive.

Medimee shall respond to the user’s request no later than one month after the request, even if the request is not complied with.

The response to the request should be clear to the user, and should be provided to the user in writing or by other (electronic) means.

  • Right to information about processing operations

Website users have the right to a clear and transparent explanation of data processing.

Through this privacy statement Medimee provides information about the source of data, the data recipient(s), the purposes, necessity and basis of data processing, data protection guarantees, retention period, contact information for complaints, user rights.

  • Right of inspection

Website users have the right to inspect, at reasonable intervals, their personal data that has been collected.

Medimee shall, if requested, provide the User with access to an overview containing at least the following data relating to the User:

  • the purposes for data processing;
  • the categories of personal data being processed;
  • the recipients or categories of recipients to whom the personal data will be transferred;
  • the retention period of personal data;
  • The right to amend, delete, restrict, or object;
  • the right to file a complaint.

When the user requests access to their collected personal data, the identity of the user is established by Medimee before access is granted.

If a copy of the data is provided to the user, no fee will be charged for providing the copy unless the user wishes to receive multiple copies and a reasonable fee can be charged for this based on administrative costs.

The copy shall be offered in writing, including in electronic form.

If the user submits the request for inspection electronically, the copy of the data will also be provided by electronic form, unless the user requests otherwise.

A copy of the personal data will be provided to the user within one month of the request.

  • Right of rectification

Website users have the right to correct or supplement their personal data if it is not accurate.

If the user does not have the ability to correct or supplement their personal data themselves, the user may instruct Medimee to correct or supplement their personal data.

Medimee shall inform all recipients of personal data of the changed data, unless this proves impossible or requires disproportionate effort in relation to the user’s interests. Medimee will provide the user with information about these recipients if requested by the user.

  • Right to data erasure

Users of the website have the right to have their collected personal data erased by Medimee, if one of the situations mentioned in Article 17, paragraph 1 of the General Data Protection Regulation occurs.

Also, the user has the right to “be forgotten” if Medimee has disclosed personal data about the user and the user requests the erasure of their data. In this case, Medimee should take the necessary measures to inform other controllers that the user wishes to erase his personal data or any copy thereof.

There is no need to comply with a request to exchange personal data if the processing of the data is necessary for one of the reasons listed in Article 17, paragraph 3 General Data Protection Regulation.

  • Right to restriction of processing

Website users have the right to restrict the processing of their personal data if one of the situations mentioned in Article 18, paragraph 1 General Data Protection Regulation occurs.

In the case of exercising the restriction on personal data processing, the data may only be processed:

  • with the user’s permission;
  • for the institution, exercise or substantiation of an action;
  • to protect the rights of third parties or for important reasons of general interest for the European Union or a Member State.

Medimee shall inform all recipients of personal data of the restriction of data processing, unless this proves impossible or requires disproportionate effort in relation to the user’s interests. Medimee will provide the user with information about these recipients if requested by the user.

  • Right to data portability

The user of the website has the right to obtain his personal data from Medimee in a structured, common and machine-readable form and transfer it to another controller, without Medimee hindering him in doing so, if there is one of the situations mentioned in Article 20, paragraph 1 General Data Protection Regulation.

If the user exercises his right to data portability, the user also has the right that the personal data be transferred directly from one controller to another, unless this is technically impossible.

The exercise of the right to portability does not affect the right to data erasure. This right shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in Medimee.

The exercise of the right to portability does not affect the rights and freedoms of third parties.

  • Right to object

The user of the website has the right to object at any time, due to his specific situation, to the processing of his personal data by Medimee.

In the above case, Medimee will cease processing the user’s personal data unless Medimee can cite compelling legitimate grounds for the processing which outweigh the user’s interests, rights and freedoms, or which are related to the establishment, exercise or substantiation of a legal claim.

When processing personal data for direct marketing purposes, the user has the right to object to the processing of his personal data at any time.

If the user objects to data processing for direct marketing purposes, the data will no longer be processed for these purposes.

  • Complaint Law

Website users have the right to lodge a complaint regarding the processing of their personal data by Medimee with the Personal Data Authority.

Both complaints regarding the processing of the user’s personal data and complaints regarding improper compliance with applicable laws may be filed.
